Re: Notice of Prospective Litigation; Demand for Records Retention
Dear MR. Miller:
I am an aggrieved citizen of the United States and of the state of Iowa, and I am contemplating filing a lawsuit against the relevant parties pertaining to the continuing concerns I have regarding the integrity of all elections that took place after December 31, 2019. Accordingly, I hereby notify you and instruct you to retain any and all documents and other materials related to all post-2019 federal and state elections through the date of this letter and continuing thereafter.
As you are likely aware, federal and, in many cases, state law requires that all records and papers which come into the possession of an election official relating to any application, registration, payment of poll tax, or other act requisite to voting in the such election be kept and maintained for a period of twenty-two months from the date of the respective election. Among the records and papers that must be maintained are paper ballots and records, which may be necessary for a post-tabulation audit.
Given the litigation I am contemplating commencing in regard to the post-2019 elections, I demand that you retain any and all records, including, but not limited to poll books; precinct register pages with signatures and button text; all voting machine tapes AVC and ICX; all results reports including the worksheet, the ICC results printout, the ICX results report, and the challenge removal reports; all public and protective count sheets for early voting; all elections verification forms for early voting; all records of elections submitted after the election reflecting all machines used in the election even if delivered on Election Day; all notation of irregularities reports; the list of early voters checked during preparation and verification; the reports printed from any voter registration computer system reflecting every individual given credit for voting Election Day, early voting and absentee by mail; up-to-date turnout reports for each county or parish in the state; and AVC layout sheets showing lockout information in each precinct.
In addition, please retain all information and documents pertaining to temporary hires, including hires from any public or private entity, for the purpose of elections; solicitation letters to qualified electors to participate voluntarily or for payment to work the election polls; any and all contracts signed by authorities vested in you with federal or state entities, including but not limited to the U.S. Department of Homeland Security, Federal Bureau of Investigation and other public or private entities (including but not limited to Craig Newmark Philanthropies and Facebook that have contracted, are currently contracting or otherwise engaging in any transactions or business with any federal or state entity to provide services, which may include but are not limited to cybersecurity, training, monitoring, transportation paper shredding, and other services ostensibly for the purpose of ensuring election integrity. This request also encompasses any and all communications, documents, e-mails, text messages, voice recordings, and other information or tangible evidence in your possession transmitted between or among public and private entities, including but not limited to the U.S. Department of Homeland Security, the Cybersecurity and Infrastructure Security Agency, and/or the Center for Internet Security, Inc.(CIS Security), including its subsidiary such as Elections Infrastrcture Information Sharing and Analysis Center (EI ISAC), relating to post-2019 federal and state elections.
This notice requires you to retain any and all records pertaining to any post-2019 federal or state election until notified in writing of the end of the retention period, including any election that may take place subsequent to the date of this letter. In the event the law mandates that a record retention period be specified, please note that all records must be maintained until at least September 3, 2023.
This records retention hold, and notice suspends any normal deletion requirements for documents, e-mail, and other information that may otherwise apply. Do not destroy, delete or in any way alter any paper or electronic information relating to my prospective claims or the other areas of interest mentioned above. Be sure to communicate this requirement to the employees who work under your supervision.
In determining what information you may have in your possession, custody or control that is pertinent to the claims described above, you should consider the following sources: paper files maintained by you or your department, whether in the office or elsewhere; personal notes, calendars or diaries; information maintained (or stored) electronically by you on any personal or company computer, network, smartphone, compact disc or DVD, jump drive, or any other electronic storage media; e-mails; voicemails; and text messages. This listing is not intended to be an exclusive listing of potential sources.
If you have possession, custody or control of any information, whether in paper form or electronic form, pertaining to my prospective claims, you are instructed to take immediate steps to preserve it in its original form. For example, do not delete any emails, internet files or other computer files containing information pertaining to the claims. You should also take steps to ensure that emails and files will not automatically be deleted by the system. Once you have identified any relevant information in your possession, please coordinate with me to ensure that I am provided with a copy of it.
If you are aware of any person employed by or otherwise affiliated with your organization, whether presently or formerly, who may have information pertinent to my prospective claims, please provide me with that information. In addition, please make sure that any person who is assigned to manage the computers or files of your organization that may contain information pertinent to my prospective claims is immediately informed of the requirements set forth in this letter. You must ensure that any such person does not delete any information and makes arrangements to preserve the information contained on the computer or in the files.
To the extent you have any concerns or questions in this regard, please contact me. Thank you for your cooperation in this matter.
Sincerely,
Kimberly Seward

Subject: REQUEST FOR CAST VOTE RECORDS-DIGITAL COPY FOR ALL COUNTIES IN IOWA-FOIA REQUEST
Greetings all county auditors and election clerks,
This is a FOIA request. I am requesting a copy of the report you sent on election night from your tabulators to the Secretary of State. This report, of the actual votes submitted to the Secretary of State is a report that you generated and do possess.
In this report are the results of the voting for your county, without names or personal information of any of the voters. Voting results are not sealed by the State. First, they are not sealed, because the report is not a paper document, it is digital in nature. If they were sealed, in a container, the purpose of the seal would be to make sure that the data had not been tampered with and was available for inspection if there were issues with the election.
I and other concerned citizens of Iowa believe, due to extensive analytics of the State and every county in Iowa, that there were significant issues with this election and even every election held thereafter. We believe the source of those issues to be external to your office and personnel and it does not involve you or your personnel. We are requesting that this “report,” generated for the Secretary of State on election night, be removed from storage, digitally copied, and then carefully returned to its proper storage location. We are further requesting that the digital copy be relayed to us as soon as practicable. We can provide you or reimburse you for a digital USB device for transfer of the data.
Relaying this data is your legal responsibility as an auditor or clerk of your county.
Maybe you have not heard about The Moment of Truth rally that took place a few weekends ago in Springfield, Mo, in which they prove that every county in the nation has been hacked. If you destroy these records after these have been requested, you may be in direct violation of the lawsuit going on right now against Iowa’s Secretary of State for Election Fraud.
Please read the letter again that is attached and even look up the rally on Frankspeech.com. Look up the Tina Peters (Mesa County clerk) case from Colorado and her documentary: https://selectioncode.com/ , this is a shocking documentary.
One of these individuals whom I would say is an expert on election fraud has been to our state and most every other state in the nation and has purposely known that our systems are hackable, along with vast other experts in Cyber security. The following are his direct quotes regarding election security in Iowa:
When I first read this “reassuring” document from Iowa Secretary of State Pate, I was so struck with how misinformed and misleading it is that I couldn’t decide whether Pate was misleading, is evil, or stupid, or willfully ignorant.
But the more I learn about him, and the more I think about it, I am now of the opinion that Pate is All of it: stupid, willfully ignorant, deliberately misleading, AND evil.
Anyone who claims that their modern electronic devices are “secure” because they are “air-gapped” is unfit for the job.
Anyone who thinks that paper ballots “can’t be hacked” has deliberately ignored the prevalent practice of ballot counterfeiting and ballot stuffing.
Now, I would first of all, not want to believe that of my own Secretary of State. As a citizen of the State of Iowa, I am requesting this information to prove that he is not the things listed above.
At The Moment of Truth Rally, there was a person there that created the first algorithm back in 2000. He believes elections have been hacked since 2004. He is also a staunch Democrat (not that that matters, as I am a Republican) and has rallied that the machines be removed in the US ever since 2004. Europe asked him a few years ago how they could make their machines more secure for their elections. He replied that there was not any way to make them secure–NOT ONE. Destroy the machines and go to a paper ballot method. All of Europe did that in their last election.
As an election official, I know that you want secure elections as do I. I hope that you will provide the information requested. Attached is also a letter detailing this information and instructions if needed.
Sincerely,
Kathryn Heilesen

Subject: Election 2022
Dear Linn County Auditor Joel Miller,
As a Linn County Resident and voter of over 60 years of age, I have become concerned regarding the integrity of our voting system. I humbly request your attention to assist me in understanding how the state of Iowa is ensuring voter integrity.
Therefore: as a citizen of the Great State of Iowa and under the Iowa Open Records Law § 22.1 et seq., I am requesting the following information:
1. Does the State of Iowa use software, hardware, any other products, or services connected to any foreign entity as part of the 2020 election or the upcoming election?
This includes any/all activities from start to finish (i.e., voter verification methods/signature comparisons, ballot scanning equipment, ballot processing software, modem downloads/access, internet connectivity, modem tape result tabulation/printing or any other step in the voting & election process.
2. Are there any foreign entity contractual agreements in any process related to the election process, specifically, but not limited to, Scytl Election Technologies S.L.U. (also stylized SCYTL)?
If so, please provide a copy of the contracts and direct me to exactly which points in the election process where foreign countries may be involved (actively or passively) and the specific Iowa State Statute that demonstrates this type of involvement is legal.
3. Have there been changes to the current policies from past elections to the upcoming elections?
The United States Department of Homeland Security (“DHS”) held a call with election officials, State Officials and agents to discuss cybersecurity in the, then, upcoming election of August 2016. At this time The Department of Homeland Security offered assistance to any state that wanted help securing its’ electronic election infrastructure. DHS sent this to every single state in this great Union. Examples of aid or assistance could include, but are not limited to, the following: fiduciary claims, financial assistance, legal aid, free devices or software, or simply advice from the Department of Homeland Security regarding the election(s)
4. Did Iowa, Linn County, accept help from the Department of Homeland Security for their elections in 2016 or any election held after 2016?
5. Did you, the Linn County Auditor office of Iowa, accept any help and/or assistance in any sort, way, fashion or methods from the Department of Homeland Security?
Due to time restraints via the statute of limitations for the 2020 elections I request a prompt response. A lack of response will be written down as a “yes/positive” in the legal action that will commence.
Please respond to my email (Kim.k.seward@gmail.com) in a timely fashion. Or send me a letter with the information I have requested to my address:
Respectfully,
Kimberly Seward

Subject: Follow UpDear Joel Miller:
Earlier this week I sent you a letter and e-mail instructing you that I am contemplating filing suit against your organization based on credible information I have received regarding your organization’s possible involvement in criminal and/or civil actions pertaining to election integrity issues. As of Friday, September 2, I have not received a response from you.
I can understand your possible confusion in wondering why a citizen who pays your salary with his or her tax dollars wishes to hold responsible the people that have contributed to the degradation of our nation’s republic and the destruction of our state and local communities. After all, for far too long now, government employees such as you have been unchallenged by the hardworking Americans upon whose backs you administer and/or uphold policies for which, in many if not most cases, the American people did not give their consent. Therefore, I shall place my instructions in the simplest possible terms to maximize the chances that you will comprehend the message I am trying to convey.
Federal, state and local government entities are largely to blame for the deplorable condition of our communities. For far too long, the American people have not had the benefit of legitimate representation across all levels of government. Evidence continues to amass which demonstrates that America has not had free or fair elections since 2017. I have reason to believe your organization may have directly or indirectly contributed to the fraudulently installed individuals whose actions have resulted in the destruction of our communities. I put this in plain terms in the hopes you will understand what I am saying – I AM CONSIDERING SUING YOU FOR YOUR AND/OR YOUR ORGANIZATION’S INVOLVEMENT IN THE FRAUDULENT ELECTIONS THAT WILL SOON BE PROVEN TO HAVE TAKEN PLACE SINCE 2017. Any attempts by you or your organization to destroy the election records and accompanying relevant documentation that I, as your benefactor and employer, have demanded you retain will be met with the harshest possible criminal and civil repercussions available under the law.
Sincerely,
Lisa McClure
